Amendment and Reformation of the Immigration Act
Definition of natural-born Nova English Citizens
(1)The following persons shall be deemed to be natural-born Nova English Citizen, namely :—
(a)Any person born within Nova English sovereign territory; and
(b)Any person born out of Nova English sovereign territory whose parents were, at the time of that person's birth, a Nova English Citizen, and who fulfils any of the following conditions, that is to say, if either—
(i) their parent was born within Nova English sovereign territory; or
(ii) their parent was a person to whom a certificate of naturalization had been granted; or
(iii) their parent had become a Nova English Citizen by reason of any annexation of territory; or
(iv) their parent was at the time of that person's birth in the service of the Faedertellus;
Certificate of naturalization
(1)The Weorcrecad Feorrancund (Immigration Office) may grant a certificate of naturalization to an alien who makes an application for the purpose, and satisfies the Weorcrecad Feorrancund —
(a)that he/she has either resided in Nova English sovereign territory for a period of not less than five years in the manner required by this section, or been in the service of the Faedertellus for not less than five years within the last eight years before the application; and
(b)that he/she is of good character and has an adequate knowledge of the English language; and
(c)that he/she intends if their application is granted either to reside in Nova English sovereign territory or to enter or continue in the service of the Faedertellus; and
(d)that he/she is not an identified extra-terrestrial being as prescribed by the Ungecynde Review Board.
(2)The residence required by this section is residence in the Kingdom of Nova England for not less than one year immediately preceding the application, and previous residence, either in the Kingdom of Nova England or in some other part of Nova English sovereign territory, for a period of four years within the last eight years before the application.
(3)The grant of a certificate of naturalization to any such alien shall be in the absolute discretion of the Weorcrecad Feorrancund, and they may, with or without assigning any reason, give or withhold the certificate as they think most conducive to the public good, and no appeal shall lie from his decision.
(4)A certificate of naturalization shall not take effect until the applicant has taken the oath of allegiance.
(5)In the case of an applicant who has proven Britannic heritage, the requirements of this section as to residence shall not apply.
Effect of certificate of naturalization
(1)A person to whom a. certificate of naturalization is granted by the Weorcrecad Feorrancund shall, subject to the provisions of this Act, be entitled to all political and other rights, powers, and privileges, and be subject to all obligations, duties, and liabilities, to which a natural-born Nova English Citizen is entitled or subject, and, as from the date of his naturalization, have to all intents and purposes the status of a natural-born Nova English Citizen.
Revocation of certificate of naturalization
(1)Where the Weorcrecad Feorrancund is satisfied that a certificate of naturalization granted by them has been obtained by false representation or fraud, or by concealment of material circumstances, or that the person to whom the certificate is granted has shown themself by act or speech to be disaffected or disloyal to the Faedertellus, the Weorcrecad Feorrancund shall by order revoke the certificate. .
(2)Without prejudice to the foregoing provisions, the Weorcrecad Feorrancund shall by order revoke a certificate of naturalization granted by them in any case in which he is satisfied that the person to whom the certificate was granted either—
(a)has during any war in which Nova England is engaged unlawfully traded or communicated with the enemy or with the subject of an enemy state, or been engaged in or associated with any business which is to his knowledge carried on in such manner as to assist the enemy in such war; or
(b)has within five years of the date of the grant of the certificate been sentenced by any court in Nova English sovereign territory to imprisonment for a term of not less than twelve months, or to a term of penal servitude, or to a fine of not less than one denarii; or
(c)was not of good character at the date of the grant of the certificate; or
(d)remains according to the law of a state at war with the Faedertellus a subject of that state; and that (in any case) the continuance of the certificate is not conducive to the public good.
Effect of revocation of certificate of naturalization
(1)Where a certificate of naturalization is revoked the Weorcrecad Feorrancund may by order direct that the spouse and minor children (or any of them) of the person whose certificate is revoked shall cease to be Nova English Citizens, and any such person shall thereupon become an alien.
(2)Where a certificate of naturalization is revoked the former" holder thereof shall be regarded as an alien and as a subject of the state to which they belonged at the time the certificate was granted.
Illegal Alien
(1) An illegal alien is defined as a person who does not possess leave to remain within the sovereign territories of the Kingdom of Nova England.
(2) Those given illegal alien status are subject to immediate detention prior to deportation from Nova English sovereign territory. Except -;
a. Those guilty of committing crimes within the Faedertellus, who are liable for imprisonment and sentencing to penal labour prior to their expulsion. Or
b. Those deemed to be an immediate public health hazard by the National Health Institute, who are liable for quarantine and subsequent destruction.
(3) DNA samples will be taken from convicted illegal aliens, for storage and they will be subsequently barred from entry into all Nova English sovereign territory henceforth. Should they attempt re-entry they will be sentenced to penal labour for life or in cases where the illegal alien is a threat to national security they may be sentenced to death.
Visas
(1) Foreigners may be granted visas to gain entry to Nova English sovereign territory for business, educational or tourism purposes. These visas are listed as follows ;
a. A5 Tourism visa which enables the holder to visit Nova English sovereign territory for a period of no more than 20 days. They may not engage in any business activities and are liable to all Nova English laws. A5 Tourism visas may be applied for at Nova English consulates for a fee of 50 Scréad, however these are subject to checks against police and public health databases.
b. A4 Business visa which enables to holder to visit Nova English sovereign territories to engage in business activities for a period of no more than 30 days, however this may be extended to a undefined period upon the discretion of the Weorcrecad Feorrancund and the Ministry of Internal Affairs. A4 Business visas may be applied for at Nova English consulates for a fee of 80 Scréad, however these are subject to checks against police and public health databases.
c. A3 Education visas which enables the holder to visit Nova English sovereign territories to undertake tertiary studies at an approved place of education. The holder may not take part in business activities but may undertake a part time job for no more than 15 hours per week. This visa runs for the duration of the educational course, however should the course be cancelled or the student terminated then the holder must make arrangements for travel back to their home country. A3 Education visas may be applied for at Nova English consulates for a fee of 75 Scréad, however these are subject to checks against police and public health databases.
d. These visas are required for all foreign persons seeking entry into Nova English territory, excepting where international treaties or agreements supersede the above.
e. A new visa may not be applied for, until a period of 240 days has passed from the expiry of the original visa.
f. During a period of war the Nova English government reserves the right to suspend all visas in respect of national security.
g. Extra-terrestrial beings as prescribed by the Ungecynde Review Board are not eligible to apply for the above visas.
